HERE IS MY QUESTION!I HAD A SOLDIER WHILE ON ACTIVE DUTY POP HOT THAT WAS EASY BECAUSE IT WAS ACTIVE DUTY AND THE GUIDELINES AND PUNISHMENT ARE EASY TO ENFORCE.NOW THAT WE HAVE RETURNED TO M-DAY GUARD STATUS ONE OF OUR NEW SOLDIERS WHO CAME IN WHILE WE WERE GONE.ADMITTED PRIOR TO HIS TEST THAT HE WOULD PROBABLY NOT PASS THE TEST WE ARE CURRENTLY AWAITING THE RESULTS,BUT AS HIS FRONT LINE LEADER I NEED TO COUNSEL HIM AGAIN ON THIS.ANY GOOD SUGGESTIONS FOR HOW AND WHAT TO APPLY TO HIM KEEPING IN MIND 1)THE TEST HAS NOT YET CAME BACK 2)HE ADMITTED THE PROBLEM BEFORE TESTING AND 3)IT IS A GUARD STATUS FOR ENFORCEMENT. HHIS STATS ARE 19 YRS OLD HAS A LITTLE OVER A YEAR IN AND ADMITTED TO MULTIPLE USES OF POT. ANY HELP WILL BE GREATLY APPRECIATED THANKS SSGP

I think you know what our drug policy is. The fact that he admitted it prior to the test does say something about his honesty but doesn't excuse the violation if the test comes back positive.

Your best bet is to let him know what his options are and what the possible consequents will be should the test come back positive. If the solder is worth keeping they should be referred to ASAP (Army Substance Abuse Program) formerly known as ADACP (Alcohol & Drug Abuse Control Program) so you will need to get the chain of command involved as this can only be done by the commander. The soldier can also self-refer themselves to the program as well if the test comes back negative but if it comes back hot it's in the commanders hands at that point.

Enrolling in ASAP won't necessarily exonerate them from consequences but it will help them get off the pot.

The Department of the Army will not tolerate alcohol/drug abuse due to the profound impact upon our defense capability. Consequently, the ASAP has been implemented to combat the ill effects of these problems. The ASAP (formerly the Alcohol and Drug Abuse Prevention and Control Program) was established by Executive Order on 28 September 1971 for the purpose of identifying and treating alcohol/drug abuse problems. The primary objective is to restore individuals to full productive performance.

Army Policy Info:

In accordance with AR 600-85, Army Substance Abuse Program, drug abuse will not be tolerated and there are serious consequences for such misbehavior.
  1. All soldiers, to include ARNG and USAR soldiers ordered to AD, under Title 10, U.S. Code, who are identified as drug abusers, without exception, will-

    1. Be referred to the ASAP counseling center for screening.
    2. Be considered for disciplinary action under the UCMJ, as appropriate.
    3. Be processed for administrative separation in accordance with AR 600-8-24 (for officers and warrant officers) and AR 635-200 (for enlisted personnel).

  2. Discharge for misconduct under AR 600-8-24 or AR 635-200, as appropriate, will be initiated and processed to the separation authority for all soldiers involved in illegal trafficking, distribution, possession, use, or sale of illegal drugs. Soldiers will also be considered for disciplinary action under the UCMJ, consistent with Chapter 6, AR 600-85 and Rule for Courts Martial 306, MCM.

  3. All ARNG and USAR soldiers ordered to AD will be tested for illegal drug abuse at their reception station.

  4. The ingestion of hemp seed oil or products made with hemp seed oil is prohibited.

Having been in this situation here is my recommendation. Prior to GWOT regs were implemented differently for reserve and national guard soldiers despite what the AR states. I would recommend the following plan of actions:

1). Contact JAG immediately and see what local policy is.
2). He made a sponstanious (statement) allowable under ucmj without rights being read.
3). Is this warrior attached for UCMJ?
4). He should be command referred to the program
5). A Counseling that has been reviewed by JAG should be prepared: On such and such date you participated in a UA, prior to the test you admitted to using____(statement witnessed by __________. As a result you are being command referred and based on the results of your test may be subject to UCMJ........add the magic statement.

It depends on how large the unit is that is getting tested and what substances they elect to test for. The actual tests though don't normally take longer than a day.

Thanks To All who have given me some good info.The one ??? of how long it takes to get the results of a drug test,I have found it varies,while overseas normally 3-5 days we had results(company size unit),but back here with the guard I have seen it take 2-6 weeks so I guess it depends where you are and who is testing and what exactly they are going to be testing for.
